Starting from August 1999, the period of activation of military activity in Dagestan, and especially after the explosions of residential houses in Moscow on August 9 and 13, mass and rude violations of human rights of citizens are taking place in Moscow and Moscow area under the pretext of searching for terrorists and preventing new explosions. These actions have systemic and centralised character and cannot boil down to single violations on behalf of executives; they mean a rude violation of the existing legislation and they are openly discriminatory, that is aimed at persons of a certain racial and ethnic group. According to their character and trend, measures, taken by Moscow authorities, do not bring about order, safety, and finding criminals, but on the contrary, contribute to the growth of tension, causing ethnic hostility.
Illegal Introduction of the State of Emergency elements
Completely ignoring the statements of President Eltsin that "all further actions should be carried out with a strict observation of the RF Constitution and Russian laws" Moscow authorities introduce a "special regime" in the city from September 13, presupposing among other measures making the rules of staying for those who arrive to the city more strict. In spite of the fact that the executives of the explosions were not found, Yuri Luzhkov expressed his complete assurance that terrorist acts were performed not by Muscovites and promised to implement "the strictest measures towards our guests". It was announced that all citizens temporary staying in Moscow had to undergo re-registration in a three day period, in the opposite case they would be drawn to responsibility up to forced turning out of the city. Corresponding order of Mayor of Moscow "On Paramount measures for the registration of citizens temporary residing in Moscow", dated September 13, 1999, was not published, so there were no legitimate grounds for its execution. Article 15 of the Constitution of the RF says: "Any normative legal acts, touching upon the rights, freedoms and obligations of a man and citizen, cannot be applied if they were not published officially for becoming known to everybody". Expert Council for Legal Expertise (chairman - councillor of justice Mara Polyakova) , after conducting an expertise of this document concluded that the Order contradicts to Article 12 of the International Pact on civil and political rights of 1996; article 2 of the protocol No. 4 to the European convention on the Human rights, articles 18, 19, 27 (part 1), 40 (part 1). 55 (part 2 and 3), 71 (p.v.) of the Constitution of the Russian Federation, to the law of the Russian Federation "On the rights of citizens of the Russian Federation on the freedom of movement, choice of a place of staying and residence within the Russian Federation", article 178 of the Code for Administrative violations in the RSFSR. The order of the Mayor contains the restriction of the most important rights of the person for freedom of movement and residence, establishing in the capital a permissive order of registration of citizens. Thus, it is mentioned in item 1.2. "To provide for consideration of matters of the registration of citizens, temporary staying in Moscow, personally by the chiefs of territorial departments and sections of departments of interior. By that it is necessary to establish the purpose of temporary staying in the city." That is the duty is not the registration of citizens, but consideration of the matters of registration, in practice - getting a permission for it.
In accordance with the order a citizen can be interfered with his residence in the city of Moscow against his/her will. In item 3 an instruction to the departments of interior is given "to take measures for not permitting entry into the city, turning out of an airport or railway stations of people, who did not register their temporary stay in Moscow," while in article 178 of the Code of administrative violations a responsibility of a citizen without a passport or registration in the form of a fine or warning is envisaged.
Experts come to the conclusion that this Order cannot be used as it is not corresponding to the RF Constitution, international legal acts and other functioning legislation. It has no legal force, as it was not published officially. Its publication, execution as well as actions of the authorities who are requiring substantiation of a registration from citizens, tuning them out of Moscow or interfering with coming to Moscow, depending on the registration, should be considered as illegal actions.
In development of the "Order No. 1007"
on September 1999 the government of Moscow publishes Resolution No. 875 "On the approval of the temporary order of movement of persons, who are violating the rules of registration, out of Moscow to the place of their residence". "The temporary order of movement..."assigns to the employees of militia to reveal citizens of the Russian Federation and of the countries of the Commonwealth of Independent States, who did not pass a registration, to bring them to on duty departments of interior for attracting them to administrative responsibility for committed violation and for solving the problem of locating them out of Moscow to the place of their permanent residence. Relocation is performed by the bodies of interior of Moscow by means of railway, air and water transport at the expense of the resources of people being relocated, and in case of the lack of them - at the expense of the department of interior of Moscow resources received in the form of registration fees. Before their relocation to the place of permanent residence the persons, subject to moving out, should be kept at the subsections of departments of interior. Upon applications of the Departments of Interior of administrative districts corresponding prefectures should provide automobile transport for the transportation of persons being moved out. The same Departments of Interior organize the work of militia for their accompanying.
Expert of the network "Migration and Law" of the Human Rights Centre Memorial Margarita Petrosyan (Leader of the network Svetlana Gannushkina), making the analysis of the Resolution N 875 of 21.09.99 came to the conclusion that this document of the Government of Moscow exceeded its authorities, violating articles 2, 11, 15, 27, 55, 56, 72, 76 and a number of other articles of the Constitution of the Russian Federation, as well as the number of Federal laws.
Resumption of military actions in Chechenia, bombardment of the cities and villages caused an unprecedented flow of refugees, concentrating mainly in the territory of Ingushetia. On September 28 Moscow authorities adopt a document aimed at limiting the appearance of refugees in Moscow - Order No. 1057 PM "O temporary measures for straightening out the work with refugees and forced migrants, arriving to Moscow, as well as with persons who apply for the registration of the corresponding status." From now on put at account are forced migrants who received the status in other subjects of the Russian Federation only if they are registered at the place of residence. Petitions on granting a status of a refugee and forced migrant are taken for consideration by Moscow migration services only if they have a registration at direct relatives. The aim of arrival to Moscow has to be indicated as the aim of receiving the status. Thus, refugees and forced migrants who are staying in Moscow and did not receive a registration are not only deprived of pensions and benefits, but they can be turned out of the city, and those from the newly arriving who managed to register at direct relatives will not have a status , and consequently pensions and benefits, if they are not able to substantiate the "Purpose of staying".
From September 15 the operation under a codified name "Whirlwind - anti terror" was underway in Moscow, in which 22 thousand employees of the law enforcement bodies took part. For the assistance to Moscow militia 9 thousand precinct inspectors from other cities were sent to Moscow. The deputy minister of interior Igor Zubov told that "Whirlwind (Vikhr') will be related not only to Moscow which suffered from the explosions, but to the whole of the country".
Violation of right for the freedom of movement and selection of the place of residence. Refusals in registration
A three day period of "re-registration" turned out to be unreal for thousands of people: gathering documents and standing in the queues occupied considerably more time, sometimes up to a week. The ones who undergone a registration had to documentarily prove that there are "grounds for their staying in Moscow", show a labour contract or a reference from the place of work together with the permission to work, which cannot be in principle with those who work at the markets.
In practice the arriving ones are registered selectively, registered are Russians, and many Azerbaijanians, Armenians, Georgians and others arriving from Transcaucasian Republics and Northern Caucasus are refused; refused are all Chechenians, even if there is a complete set of documents, required for a registration, - either explaining no reasons or referring to some "Order not to register Chechenians". A number of militia men, including the parole service and passport and visa department unofficially declared the same - that they were given oral orders based on the telephonogramme of the chief of the Chief department of Interior of Moscow to detain and not to re-register Caucasians, Chechenians first of all. Not rarely the militia men are taking away certificates on registration or put a cancellation seal on them without any clarifications, forcing the owners to leave the city in order not to be detained.
Speaking about the results of re-registration the head of the passport department of the Chief department of Interior of Moscow Mikhail Serov informed at the briefing of September 22 : We were forced to refuse to more than 15000 people from other cities. They were unable to explain the aim of their arrival, the place of their residence and... a number of other reasons. 74 thousand managed to re- register. The rest are waiting for deportation to the place of official registration. A detained infringer will write an obligation to leave the city in a three day period. If he does not leave it, the head of the department of interior will write an "order on his movement out".. We are moving out an automobile transport which is interfering in the roads, the same is here ".
To the reception of the Committee of the assistance to refugees and forced migrants "Civic Assistance" during the last days come dozens of inhabitants of Chechenia, who managed to get out of bombing and surrounding. They tell that all attempts are made not to allow them to leave Chechenia and Ingushetia. Many Muscovites are afraid to receive the arriving ones or at least register them at their places. Those who following the law and decided to register them are refused in registration at the place of their stay in Moscow.
Djamilya Khasbulatova with her husband and child arrived to the town of Lubertsy Moscow area to her friends on October 1, 1999. Together with a hostess she came for a registration to the Department of Interior "Ukhtomskoye - 2" to the head of the department of Interior Mr. Strukov. However the latter not only refused to conduct a registration but also fined the hostesses, and demanded from the guests that they should leave in three days. He stated that he had an instruction not to register Chechenians and put the hostess to shame as she was hiding "enemies".
The "Civic Assistance" Committee receives many complains from refuges and forced migrants accounted for at the Moscow migration service, having a registration at the place of location, but according to some reasons not living at the address of registration. As a rule it happens because the migrants cannot receive a registration at the place occupied because of the limiting Moscow rules of registration. To them comes a militia men, requires a certificate on the registration and making sure that it does not correspond to the place occupied, tears the certificate into pieces and requests to leave the house in which many of them live from 1990.
Here is how the Moscow Chechenian describes the registration of her relative Lomali, coming from Chechenia to children who study in Moscow: " First together with the owner of the flat she went to the office, registered documents there, paid money, received an invoice. Then she when to the passport desk of militia. The head of the passport desk told her that for registration she should pass the Service of Criminal Militia (SCM), to obtain visas of SCM Inspector and precinct inspector. In SCM her fingerprints and prints of her palms were taken, then she was photographed in profile and face and at full height. Precinct inspector checked her data according to the address bureau and made some other checks. All the checking ones put their visas. After that she went to the head of the passport desk, who without any explanations stated that he could not register her, let the head of the department decide that. The head of the department also without any explanations refused to register her. "But how I shall live here without a registration? " "Live as you wish, but I cannot register you today".
The mother of four children Zaynap Sadulaeva lives in Moscow for more than 2 years. Her 11 year old son has an oncological decease and is under a constant supervisions of the doctors of the oncological centre. Zainap was registered in Moscow at her relatives but lives in an empty flat of her friend. On September 13 a precinct militia inspector from Militia Station 138 Kozhkov came to Sadulaevs home, took the passport from Zainap and a certificate on registration and demanded to immediately leave the flat occupied, threatening with a forced turning out with a help of OMON. After the call of the "Civic Assistance" Committee employee the passport was returned to Zainap, and a certificate on registration was demonstratively torn up to pieces at Zaynap 's eyes, behaving rudely and even raising a hand at her. Zaynap applied with a complain to the head of the militia station, but he only repeated threats on forced turning out.
Rafik Gafarov from Baku has an official status of a forced migrant. Without any explanation a cancellation seal was put on his certificate of registration.
Fabrication of criminal cases
Detention of citizens, Chechenians, Ingushes, Dagestanians according to nationality at which during personal investigation a small portion of drugs or armaments (grenade, smoke box, several bullets) are "found" is acquiring a mass character. As a rule, detentions are conducted by the departments for fighting organised crimes under administrative districts of Moscow. For September 14, 529 persons were detained, who were submitted an accusation according to article 222 (illegal acquisition, transfer, sale, storage, transportation or carrying weapons, armaments, explosives and explosive devices ) and 228 (illegal manufacturing, acquisition, storage, dispatching or sale of drugs and psychothropic substances) of the Criminal Code of the RF.
Victims of militia's arbitrariness , as a rule, do not apply to Procurator's office in fear of further persecution.
According to the words of the Chairman of the Society of Chechenian and Ingush culture "Daimokh" Apaev on September 10 a group of 8-9 people, three of them in masks, came to the office of the Society. Documents of all those present were checked, including two visitors, who were taken to the Department of Interior "Koptevo". The behaviour of the militia men and their treatment of those present in the office was provocative, on the border with frank rudeness. To the requests to explain the purpose of their visit, not to go out of the framework of the law and not to swear, the leader of the society was offered to go away from Moscow to Chechenia, twice they expressed a thread that they would "Find" drugs and other prohibited articles (armaments, weapons and etc.) in the premises of the society if the chairman shall "be bugging and pull rank". Numerous detentions during the last days of Chechenians with drugs and several bullets in the pocket make grounds to perceive the threats expressed to the address of the members of the society extremely seriously.
In Novoperedelkino (district of Moscow), at the approaches to entrance to his house detained was Sultan Ismailov, born in 1966 in Grozny, who had been living in Moscow for 13 years, invalid of the 2nd group. Detention was conducted by the employees of the Department for fighting organised crime of the Central Administrative district of Moscow. Ismailov wore jeans and a shirt, he had neither jacket or coat, he had no in hands and packet or bag. After the detention he was taken into the entrance, where during a personal investigation a hand grenade and several bullets were allegedly found with him. Now Ismailov is kept in the investigation isolator of "Butyrka", a criminal case is started against him according to article 222 part 1 of the Criminal Code of the RF.
Aslan Gatiev came to Moscow from Khasav'urt (Dagestan) 10 years ago. He served in the army. At present he is finishing the Moscow State University of organization of nature utilization. He also works. Registered in the flat of his bride Nailya Pipia. he went for re-registration together with her on September 17. His turn in the queue came on Sunday, September 19. After opening his passport the precinct inspector told that dactiloscopy had to be made to all the Chehenians and took him to the 44th militia station. He did not come back from there. Militia men refused to give any information to Aslan's bride. On September 20 a lawyer visited the detained one who was told that Aslan was condemned of keeping drugs: 0.03 grams of heroin were found in his pockets. Nailya Pipia is sure that no drugs were found in Aslan's pockets before he set into militia car.
Rezvan, resident of Ingushetia, is for the 2 nd months under treatment at the Moscow hospital. He decided to spend a weekend with his relatives. On Friday his brother sent a service car for him. They arrived to his house. Another car stopped nearby. Militia men in uniforms came out of it and said that it was necessary to check the documents. They went up to the flat, checked documents, then Rezvan and the driver of a service car were taken to the 38th department of militia where they were put into different cells. Militia employees took away and threw away all medicines, available at Rezvan, threw all prescriptions from the hospital with the words: "You, bandit, have treatment in Chechenia!". Then hand cuffs were put onto Rezvan's hands behind the back and put them up to the bars, after which one of the militia men started to beat Rezvan into the chest with his knee, and another one - with a stick along his back. In the hospital the breaking of two ribs was established but no certificate on the injuries were given "we do not give such certificates to these who are not registered in Moscow".
At night on September 17 operative personnel of the Chief Department for fighting Organised Crime detained two Ingushes - Timur Dahkil'gov, born in 1967, working in the dyeing shop at the plant "Krasny Sukonshik" and his relative Bekmarza Sautiev, born in 1959. As the examination had shown there were particles of "hexagen" on Dahkil'gov's hands, and in Sautieva's flat, during the search which was conducted without attesting witnesses, weapons were found. The wife of Sautieva says that a gun was "found" in the bathroom after the employee, who conducted the search, took her out of the premises, referring to "small space". Director of the plant "Krasny Sukonshik" told to "Izvestia" correspondent that employee of the federal Security Service took probes from the hands of all painters working in the plant "and the result is the same. And arrested was only Dahkil'gov". Upon the words of the lawyer who for a long time was not admitted to Dahkil'gov, his client were subject to tortures with the aim of receiving confirmations about his connection to explosions.
Ruslan Musitov, born in 1959, residing in Grozny. Deputy Chairman of the Chechenian department of the International Human rights society. He arrived to Moscow on September 22 for the participation in the congress of the movement "Otechestvo", which took place on September 25. He was registered with his relatives at Strogino. At the congress he was proposed as a candidate for the State Duma deputy for the 37th electoral district. On September 27 the employees of the District Department for fighting organized crime called R. Musitov out of his flat into the street. There they allegedly found two match boxes with drugs and three bullets. Musitov was detained for three days, then the term of his detention was prolonged up to 10 days and he was transferred to investigation isolator No. 2.
A young Chechenian, who asked to leave his interview anonymous, said "I have been living in Moscow for a long period of time. Unfortunately, an unpleasant incident happened to my brother. He was dropped off armaments. After that - look at me, what do you see? -The pockets of his trousers and jacket, both inside and outside, were stitched. That is how we live. Thanks to our Department of fighting organised crime. First we were bandits, then became terrorists, and now becoming seamstresses."
Ira, the wife of the detained Badrudi Eskiev, passed the whole of the day on September 15 searching for her detained husband. She found him at the Department of Interior "Pechatniki". She was sent to room 503 where a man in civil cloths sat. Irina's story "I tell him: I need Eskiev. A man is lost. Where he is? ". he answers; "Probably in jail" How? Why? ""He is a Chechenian, probably smokes grass, makes injections. All Chechenians are like that". "How can you say such things? "- "And how is it possible to explode houses where people live? " "if somebody does that it does not mean that the whole of the people have to be blamed" Then he says: "A good Chechenian is a dead Chechenian. All Chechenians have to be killed". I started to cry, and said "You are not right". And he said to me "Go away, we shall be discussing that for long. Come in three days". In the morning on September 16, at the department of Interior "Tekstilshiki" the investigator Avdeeva declared to Ira that her husband was detained in the street in Tekstilshiki and drugs were found in his pockets, in connection to which a case was started against him according to article 122. In reality Badrudi was detained early in the morning at home, was taken out of the bed by militia, put on thoroughly checked clothes in which nothing was found, and taken away at his wife's eyes.
Illegal checks, detentions and penetration into premises
In the course of checks in the streets and at residential premises the employees of the bodies of the Ministry of interior are detaining and taking to militia stations the Caucasians, primarily Chechenians , Dagestanians and Azerbaijanians. Among the detained ones there happen to be people who are permanently residing in Moscow and having registration at the place of residence, permanently living in Moscow refugees from Azerbaijan and Abkhasia, people, who temporarily living or working in Moscow and having a registration at the place of location. During detentions militia men are usually eliminating registration certificates. Passports are taken from some of the detained ones (usually while checking residential premises). Some are detained for a long period of time (over three days), and many of them are not given a possibility to inform about their location to their relatives and acquaintances.
Known are many cases when the militia men entered into residential premises without a sanction of a procurator's office, with the application of force and against the will of those who lived there. Such checks were made for the premises where Chechenians and Dagestanians live. In a number of cases those living in these premises were detained, they were given orders on turning out of Moscow, and their flat sealed.
In a number of checks at the militia stations the detained ones were beaten, tortured. In the course of checking the militia employees are using the words, humiliating the national dignity of Chechenians, Azerbaijanians and other inhabitants of the Caucasus. Not rare are the cases when in the course of "Checks" valuable things and money disappeared from flats and offices.
Khadishat Edilova with two children is registered at the hired flat in Chistova street. The husband of Khadishat, Il'yas Edilov was many times refused in registration, and on September 20 Khadishat was refused in re-registration. From the moment of moving into Chistova street the family is under supervision of Precinct inspector of the department of Interior "Tekstilshiki" Nikolay Pankin. Of late Pankin accompanies his visits by the threats "to do everything for them not to live here", "Put Edilova with children to the punishment cell", "to drop off granate to them", if they do not leave Moscow, "to shoot them all", if a house is exploded again in the city. On September 29 at about 21 hours the employees of the criminal search took Khadishat, who was ill and felt very bad, to the Department of Interior "Tekstilshiki" where she was made to sign papers the content of which she did not have time to find out and was fined.
Besides the refusal in registration a "special attention" towards Chechenians is expressed in an obligatory taking of fingerprints and photographing. In particular, such a procedure is used for students, post graduate students and doctorates at higher educational and academic institutes. Sharafytdin Bisultaniv, a resident of Moscow, has a permanent residence permit in Moscow. he has six children. A precinct militia men came to the flat and said that according to the instructions of the Department of interior of the South West District all Chechenians have to be taken finger prints and photographed. For this procedure he was sent to the department of interior "Northern Butovo" where the prints of fingers of both the hands, palms were taken and he was photographed.
Magomet Dugaev, retired military pilot, served for 27 years in the Soviet Army, a resident of Moscow.: "I was taken finger prints. I went to militia in the uniform".
Saidi, "I live here from 1996. Me permanent residence is in Grozny, although there is nothing left from our street there. I have no possibility to return to Grozny, as I worked with those authorities, Zavgaev's . Here in Moscow I had a certificate on registration. A week ago a precinct inspector and some woman and one more man came to my place. They came to my place, checked and then took to Altufievskoye Department of Interior where my finger prints were taken, I was photographed: they told that it was needed. the only thing that I asked them: when you are leading me do not drop anything into my pockets. They took my certificate on registration and nobody saw it afterwards. they say - there were nothing with you. Now I am without a registration. I am trying to leave the house unnoticed, and straight to the car, State automobile inspection is not bothered with the registration, but if you leave the car... I think that this all is anti constitutional, but we have no rights and cannot prove anything. recently my relative was flying from Vnukovo to Ingushetia. 19 persons were taken out of the plane and sent to Ramenskoye department of Interior. But my relative was released, but he was not able to fly away".
Ismail. "My brother is registered near Moscow, but lives in Moscow. On September 13 he was at his working place. They arrived for him. Put with his face towards the wall. Dropped something into the pocket, and afterwards took 1 gram of heroin out of it. They were five of them from criminal search department. They themselves were witnesses, they themselves prepared a protocol, signed it and took him. He has a wife and a nine months son at home. He was detained on the 13th and the protocol was prepared on the 15 th. They were keeping him without anything, illegally, for two days. And from 15 to 18 - for three more days. he was naturally beaten. There was a crowd of people there besides him. It was not possible to sit there. He had to stand. And ever half an hour they were taken by one upstairs, to the second floor where they were beaten with sticks. Who were the detained ones. they were, as it is said at that place, "black ones" - many Chechenians, others, Azerbaidjanians, everybody from the Caucasus. In three days the documents were taken to the Procurator's office, to receive a sanction for the arrest. He did not give it. Then they made the following: they lead him out, took to the militia station again, made a protocol on minor hooliganism, that he swore in the street, signed it and gave to court. A judge told - Everything is clear, will you look for witnesses? or simply pay a penalty of 40 roubles? he was fined for 40 roubles and released. Took a recognisance not to leave".
An employee of the Chechenian tax police, sent on a business trip to Moscow. "During one day all my documents became invalid. it happened on the 14 th. I and a driver were taken to the Regional department fro fighting against organized crime. I was trying to find out what happened, by what I violated the law, and they were telling: "All of you , Chechenians , are our enemies, you are exploding our houses". I am telling again, what specifically do you have against me and what does my nationality have to do with it? "And you are working, receiving money and then send it to guerrillas!" and then returned the documents but with the warning: "if you do not live, if we meet you once again in Moscow, we shall find in your pockets drugs and explosives and armaments". And my driver was beaten and called "Chechenian toady" Now I am as if a home arrest. I do not leave a house without utter necessity. We now have no rights, unprotected and needed to nobody. Such a hunting for us never happened before. Whoever you call - every second one was in a story"
Zara Isaeva born in 1976 arrived to Moscow for treatment. On September 14 she was detained at home together with her brother's colleague Musa Vagaev and taken to the Department of Interior "Zulebino" where later on her brother< Zavlady Isaev, was taken. Zara was subjected to interrogation, during which a militia man was threatening to give her to vagrants to be raped and put her into a prison for females. then Zara was inspected in the course of which she was offered to take all her cloths off. She was released in a day. From Zavladi Isaev and Musa Vagaev's pockets something prohibited was "taken" and in the course of interrogation they were forced to give testimony beating and threatening to give Zara to be raped by vagrants.
Response of the Public and Federal bodies of State power
Federal bodies of executive power, as well as the RF President - the guarantor of Constitution - practically did not respond to the happening. The one in charge of the General procurator of the RF Vladimir Ustinov stated that it was necessary to "reveal an understanding towards the actions of Moscow authorities".
deputies of the State Duma Sergey Yushenkov, Sergey Kovalev, Edward Vorobiev, Victor Pokhmelkin and others developed a draft resolution of the State Duma "On the need of strict observation of the RF Constitution and RF legislation in conducting anti-terrorist actions", containing recommendations to the government of Moscow "to bring its normative acts" aimed at preventing terrorist activity "into strict conformity with the Constitution and RF laws". The resolution was not accepted by the State Duma. 62 deputies voted for the document and 136 - against it.
On October 6, 1999 The authorised representative on human rights Oleg Mironov declared that registration in Moscow was illegal and is subject to cancellation.
A large scale militia operation, directed against arriving from the Caucasus is actively supported by mass media, which are fostering xenophobia, Caucausophobia, Chechenophobia.
Abuezid Apaev: "Anti Chechenian propaganda is bringing its fruits. A five year boy was hit by an egg into the head, a girl was beaten at school near metro station Sokol.
Post graduate student of Linguistic University, Chechenian. A month before the defence of her thesis her registration is not prolonged to her. Her scientific advisor goes to the prorector: "help her. She is a young lady". prorector: "And who was exploding the railway station at Piatigorsk? "
